Quyền của người đăng ký nhãn hiệu
Khi đăng ký nhãn hiệu bạn được những quyền gì?
Nhãn
hiệu là những dấu hiệu của một doanh nghiệp (hoặc tập thể các doanh
nghiệp) dùng để phân biệt hàng hóa, dịch vụ của mình với hàng hóa, dịch
vụ cùng loại của các doanh nghiệp khác. Dấu hiệu dùng làm nhãn hiệu có
thể là từ ngữ, hình ảnh hoặc từ ngữ kết hợp với hình ảnh được thể hiện
bằng một hoặc nhiều màu sắc.
Một khi thương hiệu đã được phê duyệt và đăng ký, người đăng ký nhãn hiệu hàng hoá được hưởng các quyền độc quyền sử dụng nhãn hiệu, trong đó bao gồm:

Quyền sử dụng nhãn hiệu hàng hoá: người đăng ký nhãn hiệu hàng hoá có
quyền sử dụng nhãn hiệu đối với hàng hoá và dịch vụ đã được phê duyệt và
sử dụng nó trong kinh doanh có liên quan.
2. Độc quyền: người đăng ký nhãn hiệu hàng hoá được hưởng quyền, độc quyền sử dụng nhãn hiệu đã đăng ký, không ai khác sẽ sử dụng nhãn hiệu trùng hoặc tương tự đối với hàng hoá, dịch vụ trùng hoặc tương tự.
3. Quyền cấp giấy phép; người đăng ký nhãn hiệu hàng hóa được ủy quyền khác sử dụng nhãn hiệu đã đăng ký bằng cách ký một hợp đồng giấy phép theo quy định của pháp luật.
4. Cấm điện: người đăng ký nhãn hiệu hàng hoá có quyền cấm bất kỳ một từ việc sử dụng nhãn hiệu trùng hoặc tương tự đối với hàng hoá, dịch vụ trùng hoặc tương tự mà không được phép.
5. Quyền thế chấp: người đăng ký nhãn hiệu hàng hoá có quyền để thiết lập một thế chấp với nhãn hiệu đăng ký kinh doanh.
6. Phải đầu tư: Người đăng ký nhãn hiệu hàng hoá có quyền xem nhãn hiệu đăng ký của nó như là tài sản vô hình và thực hiện đầu tư theo đúng trình tự của pháp luật theo quy định của pháp luật
7. Quyền chuyển nhượng: người đăng ký nhãn hiệu hàng hoá có quyền chuyển nhượng nhãn hiệu đăng ký với bất kỳ ai khác phù hợp với pháp luật, hoặc trả tiền hoặc chưa thanh toán.
8. Di sản: Các nhãn hiệu đăng ký có thể được thừa kế bởi người thừa kế hợp pháp của mình theo trình tự thừa kế là tài sản vô thể.
